Deeds of Variation
Whilst it is simple enough for the parties to a lease to come to an agreement that it is to be varied in some way, how this is documented is not always as straightforward.
Consideration needs to be given to the type of variation and the impact this may have on the lease itself. Care needs to be taken as certain types of variation can have the effect of bringing the lease to an end and leading to the grant of a new lease, which is unlikely to be what either party wants or intends.
The provisions of the lease need to be carefully considered as this will govern what is required by way of variation, and this is frequently not as obvious as it may sound.
